What Effect Will the Virus Have on Personal Injury & Auto Accident Cases in Maryland?

Short term - the primary impact will be the delay in getting into court. While the Courts have remained open on a limited basis for certain criminal matters and proceedings, the courts are not hearing any personal injury cases. There will be a rolling opening taking place over the next several months, but the backlog of cases (both civil and criminal) will cause delays for at least the next year. And because court dates for civil matters have been pushed back, many insurance carriers have shown little interest in working out settlements on cases already in litigation.

In the event of an auto accident:

  • Call Police and EMT if you believe anyone has been injured.
  • Gather/Record information about the accident (if you have a cell phone - TAKE PHOTOS).

The following information will assist you in the event of an injury claim:

  • ames and addresses of all drivers. (Take picture of Drivers License of all vehicle operators.)
  • Insurance information for all vehicles/drivers. (Take picture of Registration and Insurance card)
  • Write down (or photograph) license plates.
  • Photograph vehicle positions and property damage.
  • Witnesses - names, addresses and phone numbers.
  • Name/Badge Number of investigating officer.
  • ​Accident Report number.

In the event of an auto accident:

  • Report your injury to the on-site manager.
  • Photograph the condition that caused your injury.
  • Obtain the names of the manager and any witnesses to the occurrence.
  • Seek medical attention for any injuries.
